1. Acceptance of Terms

By accessing or using Cherished Memories (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

2. Description of Service

Cherished Memories is a platform for families to preserve memorial content, create tribute profiles for loved ones, and purchase personalized memorial keepsake products. Digital membership subscriptions are available exclusively through our website at mycherishedmemories.com and are not sold within the mobile application.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and family PIN. Family accounts allow multiple members to share memorial content; please invite only trusted family members.

4. User Content

You retain ownership of content you upload, including photos, videos, stories, and memorial details. By uploading content, you grant us a license to host, display, and process it to provide the Service. You represent that you have the right to upload all content and that it does not infringe on the rights of others.

We reserve the right to remove content that violates our Community Guidelines.

5. Digital Memberships

Subscription plans (Free, Family Memories, Legacy Keeper, and Memorial Concierge) are billed through our website. If you subscribed via the website, your benefits are accessible in the mobile app upon sign-in. Subscriptions auto-renew until canceled. You may cancel anytime from your account dashboard on the website.

6. Physical Product Orders

Personalized keepsake products (blankets, apparel, candles, framed prints, jewelry, keepsake boxes, ornaments, and similar items) are sold as physical goods and processed through Stripe. Due to the personalized nature of these products, all sales are final unless the product arrives damaged or defective. Contact us within 14 days of delivery for replacement or refund of defective items.

7. Acceptable Use

You agree not to:

• Upload content that is unlawful, defamatory, or infringes on others' rights
• Harass, threaten, or impersonate other users
• Use the Service for any commercial purpose without authorization
• Attempt to disrupt or gain unauthorized access to the Service
• Upload content containing malware or harmful code

8. Reporting & Moderation

Users can report inappropriate content or block other users through in-app tools. We may suspend or terminate accounts that violate these Terms or our Community Guidelines.

9. Account Deletion

You may delete your account and associated data at any time through the in-app account deletion option or our Delete Account page. Deletion requests are processed within 30 days.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access to the Service. Memorial content storage is provided as a convenience, and we encourage you to keep personal backups of important photos and stories.

11. Limitation of Liability

To the maximum extent permitted by law, Cherished Memories shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts.
